Privacy Policy

The Jamaica Customs Agency (JCA) respects the privacy of our users and seeks to adhere to all applicable data protection and privacy laws. This Privacy Policy describes our policy on the collection, use and disclosure of your information when you use the JCA Mobile App and its Services and tells you about your rights of privacy and how existing privacy laws protect you.

We use your Personal Data to provide and improve the Service. By creating an account in the JCA Mobile App or use the Services therein, you agree to the collection, processing, and use of information in accordance with this Privacy Policy.

If you do not agree to the terms outlined within this privacy policy, do not create an Account, or use our Services.

The following definitions throughout this Privacy Policy shall have the same meaning regardless of whether they appear in singular or plural form.

Definitions

For the purposes of this Privacy Policy:

  • Account refers to a unique profile or an arrangement by which a user is given personalized access to the application, typically by entering a username and password. It is through this account created that you will gain access to our Service or parts of our Service.
  • Application, or App refers to the JCA Mobile App.
  • Agency (hereafter referred to as either “We”, “Us” or “Our” in this policy) refers to the Jamaica Customs Agency.
  • Device refers to any device that can access the service such as a computer, a cell phone or electronic tablet.
  • Personal Data refers to any information which are related to an identified or identifiable natural person.
  • Service refers to the mobile application or any functionalities therein.
  • Service Provider refers to any natural or legal person who processes the data on behalf of the JCA. It refers to third-party companies or individuals employed by the JCA to facilitate the Service, to provide the Service on behalf of the JCA, or to perform Services related to the mobile application.
  • Usage Data refers to the data automatically collected, either through use of the Service or from the Service infrastructure itself.
  • You refers to the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

 

Collection and Usage of Your Personal Data

Types of Data Collected

Personal Data

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to:

  • Full name
  • Tax Registration Number (TRN)
  • Company TRN
  • ASYCUDA World (AW) Username
  • Date of Birth (DOB)
  • Email Address
  • Phone number
  • Address, State, Province, ZIP/Postal code, City
  • Usage Data

Usage Data

Usage Data may include information such as your device’s Internet Protocol (IP) address, the pages of Our Service that you visit, the time and date of your visit, the time spent on those pages, and other diagnostic data.

When you access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, the IP address of your mobile device, your mobile operating system, and other diagnostic data.

Use of Personal Data

The JCA, through its app, may use personal data for the following purposes:

  • Account Management: to maintain your application as a user of the Service. The Personal Data provided by you will allow for different functionalities of the service that are available to you as a registered user.
  • To contact you: Should the JCA need to communicate information, you may be contacted by email, telephone calls, Short Message Service (SMS), or any other equivalent forms of electronic communications including, but not limited to, push notifications, to provide information related to the app’s functionalities, updates when necessary or reasonable for their implementation.
  • Requests Management: To attend to and manage your requests to the Agency.

 

Retention of Your Personal Data

The JCA will retain your personal data only for as long as is necessary for the purposes set out in this Privacy Policy, after which it will be disposed of in a secure manner. We may retain and use your personal data to the extent necessary to:

  • Adhere to legal and regulatory obligations.
  • Resolve disputes that may arise.
  • Comply with tax, and accounting obligations.

The JCA will also retain Usage Data for internal analysis purposes. Usage Data is generally retained and used to strengthen the security or to improve the functionality of our Service, or as legally obligated to retain this data.

 

Deactivation of your Account

You have the right to deactivate or request that we assist in deactivating your Account. Deactivation of your account does not ensure complete erasure of information provided by you while you were a registered user, in keeping with applicable privacy and data protection laws that govern the JCA.

 

Disclosure of Your Personal Data

We will not share, sell, or distribute your personal data to any other entities or utilise your personal data in other ways than the purpose for which it was collected and stored that contravene any Act, Rules or Regulations which govern the JCA.

Legal Requirements

The JCA may disclose your personal data necessary to:

  • Comply with legal obligations of the JCA.
  • Protect and defend the rights or property of the JCA.
  • Prevent or investigate possible wrongdoing in connection with the Service.
  • Protect the personal safety of Users of the Service or the public.
  • Assist in the protection of Jamaica’s borders.
  • Protect against legal liability.

Law enforcement

The JCA may be required to disclose your personal data if required to do so by law or in response to valid requests by public authorities (e.g., a court).

 

Personal Data Security

The JCA prioritises security of your personal data. We employ administrative, organisational, and technical safeguards to protect your personal data and are constantly working to improve these safeguards to help keep your personal data secured from unauthorised access, access, alteration, destruction, loss, and misuse.

To assist us with protecting your personal data, where you have an account on the app, we encourage that you utilise a strong password, take protective measures to secure your account from unauthorized use, and do not use the same log-in credentials (username and password) as with other services or accounts. If you believe your account has been compromised in any way, please contact us immediately.

 

Changes to this Privacy Policy

The JCA reserves the right to revise and update this policy at any time without notice, to reflect new services of the app, changes to our privacy practices or relevant laws. We will attempt to notify our employees, clients, and customers of any such modifications electronically and by other means where possible.
